Convicted of illegal extraction of timber in MT may appeal on freedom
The second Chamber of the Supreme Court (STF) concluded today (6) judgment of Habeas Corpus (HC) 110120 and allowed, by majority vote, that five defendants appeal on freedom of sentence of judgement of the 5th Federal Justice Court in Mato Grosso that condemned them for illegal extraction of wood in the indigenous area (environmental crime), possession of a firearm and conspiracy.
The trial resumed today with the vote-view of Minister Carmen Lucia, who accompanied the Rapporteur of the case, Minister Gilmar Mendes, in the sense of granting habeas corpus. She pointed out that by prolatar the enforceable judgment, the judgefirst cousin made no reference as to the need for continuity of the prison of the condemned. The Minister Celso de Mello also vote accordingly.
At the beginning of the trial of HC, in March 2014, the rapporteur and the da's Zavascki Minister voted in order to confirm the preliminary injunction previouslygranted, to which the defendants respond in freedom to prosecution for lack of evidence to justify the maintenance of protective prisons. On the same occasion, the Minister Ricardo Lewandowski delivered a dissenting vote. For him, the precautionarysegregation is justified given the gravity of the crimes committed.
