Maintained former prison Buriti (MA), indicted for crimes of responsibility
Luís Roberto Barroso, Minister of the Supreme Court (STF), denied the Habeas Corpus (HC) 135491 and held pre-trial detention declared against Francisco Evandro Freitas Mourão Coast, former Mayor of Buriti (MA), also known as Baby Mourão. The habeas was filed against a decision of the rapporteur in the Superior Court of Justice (STJ) rejecting request for revocation of the precautionary and prison infeasible HC.
Indicted for alleged crimes of responsibility (article 1, I and V, the Decree 201/1967 in conjunction with article 69 of the Penal Code) and crime against the law of Tenders (article 89 of the 8,666/1993 Law combined with article 71 of the Penal Code), when he held the post of Mayor, Baby Mourão had preventive detention enacted to ensure the guarantee of public order and for convenience of the criminal. The Mayor claims the lack of requirements for declaration of precaution. According to remedy whatsoever, the prison would have been enacted only because he left to present thepreliminary defense in the main proceedings.
To deny the request, the Minister Barroso noted that, from the procedural point of view, the writ of habeas corpus was filed on replacing a further regimental against the decision of the rapporteur, who should have been filed in the SUPREME COURT. The Minister cited precedents from the first Panel of the SUPREME COURT to the effect that, by inadequacy of via elected, the process should be extinct without resolution.
"In fact, not existing collegiate pronouncement of the Superior Court of Justice, it is not for the Supreme Court to examine the question of law involved in the remedy whatsoever", stressed the rapporteur.
